What is a Pre-Action Protocol letter?

A Pre-Action Protocol for Debt Claims letter (often called a "Letter of Claim") is a formal legal document that creditors must send before starting court proceedings against individuals or sole traders.

Why we send it

The Pre-Action Protocol is part of the Civil Procedure Rules. Before a creditor can apply to the county court for a debt, they must first send this letter and give you at least 30 days to respond.

What's included

The letter includes:

  • The amount owed and how it's made up
  • An Information Sheet explaining your rights and options
  • A Reply Form for you to complete and return
  • A Financial Statement form (if you wish to share your financial circumstances)
  • Your 30-day window

    You have 30 days from the date on the letter to:

  • Pay the full amount
  • Agree a payment plan
  • Dispute the debt using the Reply Form
  • Contact a free debt adviser
  • We cannot start court proceedings until this period has expired.

    What if you dispute the debt?

    Complete the Reply Form and return it to us. We'll investigate and pause action while we do.
